WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT
This is a Waiver and Release of your legal rights, and an Agreement not to sue.
Serious Injury or Death may result from participating in recreational activities.
In consideration of being permitted to participate in the recreational activity, and
specifically including the riding of All Purpose Vehicles (APV's), the undersigned ("Releasor") executes this Waiver and Release of Liability and Indemnity Agreement (Release) and hereby states and agrees as follows:

I am aware of the risks of injury and death inherent in recreational activities (including the
operation of APV's) and I acknowledge that I have read this entire Wavier and Release. I hereby expressly assume all risk associated with all such recreational activities.

I hereby release, waive and discharge Brent Millhone and Perry Backwoods Campground, LLC of New Lexington, Ohio, their employees, all other persons or entities acting on their behalf, and any landowners (including Brent Millhone) or lessors allowing Perry Backwoods Campground, LLC as well as Perry State Forest to use their land for recreational
activities, including the operation of APV's (referred to as "Releasees"), from all liability to me, legal representatives, heirs, successors and assigns, for any and all loss, injury or damage, and any and all claims arising on account of injury to my person or property or my death while I am engaged in any recreational activity in any way operated, managed or coordinated by Perry Backwoods Campground. I hereby waive my right to sue Perry Backwoods Campground, LLC and the aforementioned landowner on account of injury to my person or property, or my death while engaging in recreational activities. I hereby agree to indemnify and hold harmless Releasees from any loss, liability, damage or cost they may incur due to my presence in, upon, or around property being used for the recreational activity for the purpose of or due to my participation in such activity. By signing this document, I agree and acknowledge that I may be giving up important legal rights and remedies available to myself, my family, my heirs, successors and assigns.

I am aware that outdoor recreational activities involving the use of APV's can be hazardous.
I understand that I may sustain loss, damage or injury to person or property resulting from or in any way connected with transporting or use of equipment furnished by Perry Backwoods Campground, LLC or their agents including the property of Perry Backwoods Campground, LLC. I understand that the use of an APV and related equipment including the property of Perry Backwoods Campground, LLC furnished by Perry Backwoods Campground, LLC constitutes an acceptance of said equipment or property on a lease basis "AS IS". I agree to pay for any damage done to said equipment or property of others including the property of Perry Backwoods Campground, LLC. If I fail to return or cause damage any or all equipment or property used by me in the participation of the recreational activity, I agree to reimburse Perry Backwoods Campground, LLC for the amount of replacement cost. If Perry Backwoods Campground, LLC is required to search for property or equipment used by me in the participation of this activity due to irresponsible actions by me, I will pay for said search.

I HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO THIS WAIVER AND
RELEASE OF LIABILITY AND INDEMNITY AGREEMENT. I FURTHER AGREE THAT
NO ORAL STATEMENTS, REPRESENTATIONS OR INDUCEMENTS APART FROM
THIS WRITTEN AGREEMENT HAVE BEEN MADE TO ME TO OBTAIN MY CONSENT.

**This release shall be effective from 04/01/2017 to 04/01/2018.**

Perry Backwoods Campground Agreement of Rules

I/we understand that signing this agreement I/we will follow all rules, sign waivers, and respect all property of Perry Backwoods Campground, LLC.

I/we will use caution at all times while on the Perry Backwoods Campground, LLC property.

I/we understand that helmets are to be worn at all times including during the loading and unloading of APVs.

I/we understand that all ramps used for loading and unloading APVs and equipment must be secured to the vehicle/trailer.

I/we understand that the use of chainsaws is prohibited on Perry Backwoods Campground, LLC property.

I/we understand that fireworks are prohibited on Perry Backwoods Campground, LLC property.

I/we understand that discharging of firearms is prohibited on Perry Backwoods Campground, LLC property.

I/we understand that by lighting a fire, I/we are accepting responsibility & consequences of a fire. Fires are only permitted in fire rings and must be monitored at all times.

I/we understand that alcohol may not be consumed while riding trails are open (from a half hour before sun rise – a half hour after sunset and should only be consumed in moderation. Excessive intoxication could result in being asked to enter and remain in your sleeping quarters.

I/we understand that generators may only be used between the hours of 7:00am – 10:00pm.

I/we understand that washing APVs or vehicles on gravel roads or with Perry Backwoods water supply is prohibited unless in the designated area. If caught a fee of $10 will be charged for water usage.

I/we understand that riding is only permitted to and from the Perry State Forest trails. Marked speed limit must be obeyed at all times. Joy riding and hot laps are not permitted.

I/we will dispose properly any and all garbage brought in. My trash is my trash until disposed of in the proper receptacle.

I/we understand that pets must be leashed. You must clean up after your pet. You are responsible for your pet while on Perry Backwoods Campground, LLC property.

I/we understand that children must be supervised by an adult. All liability for the child remains with the responsible adult.

I/we agree any damage I/we incur while at Perry Backwoods Campground, LLC, will be at my/our expense.

I/we agree to report any hazards or incidents to a Perry Backwoods associate or the Owner @ (330) 224-0759.

I/we understand that anyone caught on Perry Backwoods Campground, LLC without authorization or owner's acknowledgement will be charged a $100 fee or be prosecuted for trespassing.

I/we understand that Perry Backwoods Campground, LLC is not responsible for accidents or any lost or stolen property and understand I/we are riding at our own risk.

Perry Backwoods Campground, LLC has the right to refuse anyone service.

We recommend that all riders become members of the OMTA for a fee of $20.00 per year per rider for liability insurance. Ask us how.

The period of this agreement is for 04/01/2017 to 04/01/2018
